Based on the 1951 UN Convention, Individuals applying for asylum in the UK are required by law to demonstrate a well-founded fear of persecution in their present countries of residence. This can be due to the fact that they have been persecuted because of their race, religion, nationality, membership of a particular social group or political opinion. Furthermore, the individual must illustrate that owing to such fear, he/she is unwilling to avail him/herself of the protection of that country; or who not having a nationality and being outside the country of his/her former habitual residence is unable or, owing to such fear, unwilling to return to it. Also, in conjunction with this, an individual is allowed to argue that his/her Human Rights will be violated as well. A successful Asylum appeal may result in an individual obtaining 5 years limited leave to remain in the UK.
